The National Highway Traffic Safety Administration has turned a critical eye on Tesla’s full self-driving software, citing recurring hazardous behaviors that endanger both drivers and pedestrians. While intersections have emerged as primary hotspots for these issues, the federal agency has pledged to examine other high-risk scenarios, including driving adjacent to opposing traffic lanes and approaching railway crossings. Reports from NCB news highlight that Tesla’s FSD system frequently falters at railway crossings, sometimes ignoring flashing red lights or lowered gates, an alarming lapse in safety protocols.

Tesla’s regulatory troubles are not confirmed to FSD. Earlier this year, NHSTA initiated an inquiry into the automaker’s “summon” feature, which allows vehicles to autonomously navigate parking lots to reach their owners. This investigation followed a spate of minor collisions linked to the system, raising questions about the reliability of semi-autonomous maneuvers in confined, unpredictable environments.

The scrutiny of Tesla’s autonomous technologies is layered atop a history of legal and regulatory challenges. In August, NHTSA opened an investigation into the company’s alleged failure to report crashes promptly, a statutory requirement designed to ensure accountability and public safety. Meanwhile, a Miami jury held Tesla partially liable for a fatal 2019 accident involving its Autopilot system, distinct from FSD. The jury’s ruling, which awarded more than $240 million in damages, underscores the potentially catastrophic consequences of system errors. Tesla has announced its intent to appeal, signalling that the legal and regulatory dialogue is far from over.
